HOUSTON – A Houston area family is suing a fast food chain after they say a worker pulled out a gun and shot at them.
The family said they were at a Jack In The Box drive-thru window back in March 2021 when they got into an argument with the employee about curly fries.
“It was scary. It was very, very scary,” Anthony Ramos said.
Ramos said an employee working the drive-thru window opened fire on him, his pregnant wife, and their 6-year-old child who was in the backseat of their vehicle after an argument over the fries, which they had already paid for.
“After they had paid for their meals, they looked into the bag and did not find any curly fries, and when they asked to get curly fries, they were denied,” said attorney Randall Kallinen.
Ramos’ attorney said a discussion led to shouting and ended with the female employee swearing and pulling out a gun and firing a shot at them as Ramos drove away.
“Thank God nothing happened to my family but it could have been worse and that’s unacceptable,” Ramos added.

By suing Jack In The Box, Ramos said he hopes this will legally require the company to strengthen and refine its policies and business practices used to vet its employees.
“They need to hire better quality people. That’s really what I’m after. To make sure that this kind of situation that happened to me and my family never happens again,” Ramos said.
Houston Police investigated and arrested the female employee for aggravated assault with a deadly weapon. She pleaded guilty to a lesser charge of deadly conduct.
Jack In The Box told KPRC 2 that it does not comment on ongoing legal matters, particularly those which involve independent franchise owners.
